Alleged 3.1b Fraud: Absence of Suswan`s Counsel Stalls Adoption of Final Written Address The trial of a former governor of Benue State, Gabriel Suswam before Justice Peter Lifu of the Federal High Court Abuja on Friday, October 2, 2026 could not continue due to the absence of his lead counsel, J.P Daudu, SAN. Suswam and Okolobia Okpanachi, former commissioner of finance in the state are being prosecuted by the Economic and Financial Crimes Commission, EFCC on a nine-count charge bordering on diversion of N3.1 billion. Prosecution counsel, O.A Atolagbe, at the start of the proceedings informed the court that the matter was slated for the adoption of final written addresses and on the part of the prosecution, he is ready but he received a letter from the first defendant`s counsel asking for an adjournment on the ground that the lead counsel, Daudu, will be attending the International Bar Conference, between October 4 and 9, 2026. “We ask to be on record that this application is a deliberate plot to frustrate this proceeding. This is a 2015 charge and this honorable court has treated this matter expeditiously and my lord is committed to this matter. Evidences have been concluded since November 2025 and this is not the first time the first defendant will be asking for an adjournment just on the adoption of final addresses. My lord you recall that on July 16, 2026, the first defendant and his counsel were not present. The record of this court is very clear that J.B Dauda,SAN has not conducted substantially the proceedings of this case, it has been Chinelo Ogbozor who conducted all the proceedings since 2015, If we continue this way, the entire case will be frustrated” he said He further pointed out that for the sake of fair hearing, he is constrained to object to their application so as not to create further hurdle to the completion of the case. Justice Lifu adjourned the matter to November 6, 2026 for the adoption of final written addresses.
